Who's fault was Spanish train crash?

Oh really, "reasons not yet known". I think the driver just confessed.
I think the driver should be charged with second degree murder because it was not premeditated.
Well at least that is the law in the U.S., I'm not sure with the Spanish legal system.

Don't try to make the US legal system look superior, just don't... You have the fullest and most prisons and yet crime is still at large.

Mandos, he never did that, he was speaking from his own knowledge and never said a thing about the US being superior in any way. Quit being so belligerent.

No, I really don't think he was. I know a grand total of 0 americans who like our justice system anyway.

I think the driver admitted that it was his fault so he's going to end up paying massive fines at least. Not sure if murder is the right word but I'm sure the Spanish court judges him fairly.

I'd figure it was Manslaughter. The incident occured on a high speed railway with a maximum safe speed of 200kph, it's just this one corner that had a reduced speed limit, so I figure the driver may simply not have been aware of it. Still, he could (and perhaps should) have been very aware of it, so he couldn't get away with Accidental Death. As there was most likely no intent, however, Involuntary Manslaughter would seem to be the most correct charge...

It has been said in various sources that the driver had driven the same route for over a year, so he should have been very well aware of that curve...

He was already arrested. And if I remember right from this morning the speed limit in the corner is 90 kph.

Being arrested doesn't mean one is guilty of anything, just that there is suspicion...
